General terms and conditions

This is the website of the Design Council.  By using this website the user agrees to be bound by its Conditions of Use and acknowledges that it contains proprietary intellectual property and copyright information, the terms of which are set out below.

Whilst the Design Council takes every care to ensure that the materials, information and data (together the 'Materials') provided on this site (the 'Website') are accurate and up-to-date, we must emphasise that the Materials are provided on an 'as is', ‘as available’ basis and without warranty or guarantee of any kind, whether express, implied or statutory, or whether relating to title, the rights of third parties or otherwise.

The Design Council reserves the right, at its absolute discretion, to add, revise or remove any Materials without notice.

The Materials are designed for outline guidance and general information purposes only and the Design Council does not make any warranty as to whether the Materials offer appropriate guidance in relation to any particular set of facts. As such, professional advice should be sought where necessary and reliance on the Materials or the Website is at your own risk. The Design Council assumes no responsibility for information contained in the Website and disclaims all liability in respect of such information.

The Design Council cannot guarantee that the software and hardware you use to access the Website meet the requirements for viewing and accessing the Materials, and cannot be held responsible if you are unable to access the Website or the Materials for any reason connected with the software and hardware you use. 

The Design Council makes no warranty that the Materials are free of infection by computer viruses or other contamination.

The downloading of any of the Materials is at the individual user's own risk and the user will be solely responsible for any damage or loss, whether suffered by the user or a third party in consequence of the user's actions, which results from a download and/or use of any such Materials.  The Design Council gives no guarantee that access to the Website will be error free or uninterrupted, and the Design Council will not be liable for any loss or damage caused be any interruption or error except where such loss or damage relates to any fraudulent misrepresentation made by the Design Council or death or personal injury caused by its negligence.

The Design Council is not responsible for any content of any other website accessible from the Website, nor does it endorse or in any respect warrant any third party products or services by virtue of any information, material or content referred to or included on, or linked from or to the Website.

The host server for the Website is located in England, and the applicable law in respect of the Website shall be the laws of England and Wales only.

Terms and conditions for blogs and postings

We welcome your contribution to discussions on the Design Council website.  Please note, however, that the blogs and forums on the Design Council website are merely a conduit for the provision of information, education and entertainment, and that the submissions displayed on the forum and the blogs are not subject to any selection or alteration by the Design Council. 

Despite the fact that we ask users to warrant that information provided during registration on the Website or in submissions to the forums and the blogs is correct the Design Council have no way of verifying this and as such you should take care and think carefully when using the forums and the blogs. People are not always who they say they are and although this is regrettable you agree and understand that the Design Council is not responsible for the acts or omissions of users of the forums and the blogs.

You agree and accept that the Design Council has no responsibility to review the content of any submissions or communications or contributions to (or which are part of) the Forum or the blogs, all of which are made available on the basis that the Design Council shall not be required to exercise any control or judgement of the content or the material posted or contained therein.

The views expressed in any submissions to the forums or blogs are the views of the individual contributors and not those of the Design Council unless specified otherwise by the Design Council. In particular but without limitation to the above the Design Council is not responsible for and disclaims all liability in respect of any comments, views or remarks expressed in any submissions to the forums and the blogs.

The Design Council gives no warranty and makes no representation as to the accuracy, currency or validity of the information and material contained within the submissions to the forums or to the blogs, and shall not be responsible for any loss or damage caused as a result of any use of such material.

The Design Council has no control over the accuracy, truth, validity or content of any submission to the forums or the blogs nor whether the person making a submission is who they say they are or entitled to make it.

Please note that comments should be in keeping with the overall tone of discussion and must not:

  • Contain objectionable language, including racist, sexist, homophobic, sexually explicit or abusive comments
  • Contain swear words or other language that is likely to offend
  • Condone or encourage unlawful activity
  • Infringe others’ copyright, design right, patent, rights in confidential information or any other intellectual property rights, without limitation
  • Be repeatedly posted
  • Contain any contact details
  • Contain defamatory comments
  • Be irrelevant to the topic under discussion
  • Contain content that you have copied or are not sure about its ownership
  • Advertise a product or service
  • Impersonate someone else
  • Include any information which is fraudulent or misleading
  • Harasses any person
  • is technically harmful such as computer viruses, worms, logic bombs or other malicious software or harmful data;
  • Contains any links to information or material in breach of any of the above provisions

The Design Council reserves the right to refrain from publishing comments and/or to remove any that fall into these categories.

You agree to indemnify and hold harmless the Design Council against all liability it may have in respect of and arising out of submissions you make to the forums and the blogs.

In the event that you believe that you have any action or claim against another user as a result of that user’s behaviour in the use of the forums or the blogs, you agree to pursue such an action or claim independently of the Design Council and understand, agree and accept that you shall have no right to pursue the Design Council for any claims, liability, damages, losses, costs and expenses, including legal fees, arising from or in any way connected with such right, claim or action.

By contributing to discussions on the Design Council website you are agreeing to our Blogs and Forums terms and conditions. 

Violation of the above guidelines may lead to the suspension of your registration with any Design Council websites.

Copyright

By posting comments to the Design Council websites you are warranting that they are your own original work and that you grant to the Design Council a perpetual, royalty-free, non-exclusive licence to reproduce, modify and use them in all media and for an unlimited duration.  Such use shall be consistent with the provisions set out in the Design Council’s privacy policy and in no way limits your own rights as copyright holder in them, save that you may not revoke, or cause the revocation of the rights granted hereunder through an agreement with any third party.

Copyright and intellectual property (IP) policy

Except where expressly stated to the contrary, all copyright and rights in performances in this website (including but not limited to text, sound recordings, performed works, photographs, graphics, design, layout and software) is owned by or licensed to the Design Council.  All rights are hereby reserved by the Design Council. 

“The Design Council”; “Designing Demand”; “Dott07” and “Design Index” are among the trademarks or registered trademarks owned or licensed to the Design Council.  All other brand and product names are or may be trademarks of, and are used to identify products or services of, their respective owners.

The modification, transmission, re-use, reposting, permanent copying, and/or storage of all or part of the content on the Design Council’s website or reproduction or incorporation of all or any part of the content in any other work or publication, whether paper or electronic media or other form, is expressly prohibited without the prior written consent of the Design Council. You may not provide any hypertext links, graphic links or any other direct link to the display of the content on this website without having first received the written permission of the Design Council.

On occasion the Design Council allows limited reproduction of some of its text and images, where:

  • The Design Council has granted explicit written permission
  • This is in-line with the Design Council’s organisational objectives
  • No commercial benefit will be gained
  • The content is used in a manner congruent with the Design Council’s aims
  • Text, graphics, photographs and other images may only be shown with an appropriate credit stating that the material is reproduced with the permission of the Design Council and that the Design Council own the copyright in the material.

This form must be completed, and the Design Council’s written consent gained, prior to reproduction of any content, with the sole exception of the following:

Notwithstanding the above statement, you may copy small sections (in any event not more than five pages) of the Design Council’s website content for personal use and recopy to individual third parties for their personal information provided that (i) you acknowledge the Website as the source of the content (ii) such an acknowledgement and suitable reference to the Design Council is made in the copy of the content and (iii) you inform the third party that they are subject to and must comply with the conditions of this Website. This permission is, however, revocable at any time by the Design Council.

Creative Commons policy

In some cases the Design Council makes some of its work available to download under a Creative Commons licence.  This is to encourage the distribution of, and discussion about, certain pieces of work. 

NOTE: THIS LICENCE DOES NOT APPLY TO ALL OF THE DESIGN COUNCIL’S WORK, MOST OF WHICH IS STILL PROTECTED BY STANDARD COPYRIGHT.  THIS STATEMENT ONLY APPLIES TO WORK CLEARLY MARKED WITH A CREATIVE COMMONS LICENCE.

Where a licence is shown, this work is available to be downloaded, copied and distributed free of charge but under the following conditions:

  • The Design Council must be credited as owners
  • A link to www.designcouncil.org.uk must be displayed along with a copy of this licence
  • Work must only be altered with our written permission
  • Work must not be resold
